BCRTA members may qualify for a financial settlement if they have used LifeLabs for test results. A data breach of the database revealed the personal details of thousands, sparking a class-action lawsuit and subsequent settlement.

WHAT IS THE APPROVED SETTLEMENT?
A Class Action was commenced following a criminal cyber-attack on LifeLabs’ database of customer personal health information, announced by LifeLabs Inc. on December 17, 2019 (“the Action”). LifeLabs defended the Action, and denied all allegations.
On October 25, 2023, the Ontario Court approved a Canada-wide Settlement Agreement and Distribution Protocol for up to $9.8 million.
AM I A SETTLEMENT CLASS MEMBER?
You may be a Settlement Class Member if you live in Canada and were a LifeLabs customer on or before December 17, 2019.
HOW MUCH WILL I BE PAID IF I MAKE A CLAIM?
Each Settlement Class Member who completes a valid claim form, on time, will be eligible to receive estimated compensation of $50, up to a maximum of $150, from which will be deducted Court-approved legal fees, disbursements and taxes. The precise amount to be paid per person will be determined based on the total number of claims filed.
HOW DO I SUBMIT A CLAIM?
You must submit a claim between December 8, 2023 and no later than April 6, 2024, in one of three ways:
- File a completed claim form on the secure, online website at: https://lifelabssettlement.kpmg.ca.
- Email a completed Claim Form to the Claims Administrator at: lifelabssettlement@kpmg.ca.
- Mail a completed Claim Form by ordinary mail to the Claims Administrator at the address specified below.
Note: Claimants are encouraged to submit the online Claim Form, as electronic submissions will be processed quickly. The Claim Form requires you to provide a valid provincial health card number to prove you are a member of the Class. You must also choose to be paid by e-transfer or by cheque. Payment will be expedited if made by Interac e-transfer, rather than cheque. In addition, a processing fee of $2.00 will be deducted if you request a cheque.
WHEN CAN I EXPECT TO RECEIVE A PAYMENT?
Payment will be made after the Claim deadline (April 6, 2024) to persons who have been verified to be a Class Member by the Claims Administrator, and who have submitted a valid Claim Form, on time.
